Welcome to FIX UP ("we", "us", "our"). By using the FIX UP website, mobile apps, or any associated services (together, the "Service"), you agree to these Terms & Conditions. Please read them carefully. If you don't agree, please don't use the Service.
1. Who can use the Service
You must be at least 18 years old and able to enter into a legally binding contract under Kenyan law. You're responsible for keeping your account credentials confidential.
2. Roles on the marketplace
FIX UP connects three kinds of users:
- Customers request services and pay for them.
- Service providers accept jobs and perform the work.
- Suppliers list tools and supplies.
We are a marketplace. We are not the service provider for the work you book. Each provider is an independent contractor responsible for the quality and safety of their work.
3. Bookings, quotes, and acceptance
- A booking is a request for service. It becomes a binding engagement only after a provider claims it via the Accept action or a quote you accept.
- Quotes are estimates based on the description you provide. On-site reality may require an adjustment, which the provider must communicate before any extra work.
- The six-digit acceptance code shared on a booking is the provider's authorisation to view your exact address. Don't share it with anyone but the provider you intend to use.
4. Payments
Pricing is shown in Kenyan Shillings (KES) and is inclusive of applicable taxes unless stated otherwise. Payment terms, refunds, and dispute handling will be detailed in the Service once payments launch.
5. Conduct
You agree not to: harass other users; misrepresent your identity, services, or pricing; circumvent our matching system to avoid platform fees; or use the Service for anything unlawful.
6. Cancellations & refunds
Cancellation rules differ before vs after a provider has been assigned to your booking. The detailed policy will be published in the Service before the first paid booking.
7. Liability
To the maximum extent permitted by law, FIX UP is not liable for indirect, incidental, or consequential losses arising from your use of the Service or from the actions of providers, customers, or suppliers. Nothing in these Terms excludes liability that cannot lawfully be excluded.
8. Termination
We may suspend or terminate accounts that violate these Terms, repeatedly fail to honour bookings, or pose a safety risk to other users.
9. Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date. Continued use of the Service after the update means you accept the new Terms.
10. Governing law
These Terms are governed by the laws of Kenya. Any dispute will be subject to the exclusive jurisdiction of the courts of Nairobi.
